1. Who provides the service, and to whom
The service is provided by Juan Cantón Rodríguez (Spanish tax ID 45492167F), with address at Carrer de Pau Casals 19, 4º 2ª, 08213 Polinyà (Barcelona), España, trading as «Francodesystems» («we», «us»).
Sourevo is a service for businesses and professionals. Whoever creates an account declares that they act in the course of their business or profession and, if acting for an organisation, that they are authorised to bind it. Consumer protection rules therefore do not apply.
There are two kinds of account: customer accounts (importers, operators, traders and forwarders or authorised representatives, who register an organisation) and supplier accounts (producers and exporters at origin, who declare their details and plots in the supplier portal).
2. What the service is
Sourevo is a cloud software tool to prepare and manage compliance with Regulation (EU) 2023/1115 (EUDR). Among other things:
- Management of suppliers, plots with their geolocation (point or polygon), evidence, products and batches.
- A supplier portal where suppliers declare their plots and decide which customers they share them with.
- Pre-validation of data (for example the 4 ha point/polygon rule, quantities, mandatory fields) and supplier trust indicators based on objective checks, such as validating their tax ID against public registries.
- Preparation and submission of due diligence statements (DDS) to the European Commission’s TRACES NT information system through its official web service, and their amendment, withdrawal and status checks.
- History of statements and changes, to help you keep your records.
- For forwarders and authorised representatives, management of several organisations or operators from one account.
Specific features may evolve. If we remove an essential feature of a paid plan, we will give you reasonable notice.
3. Sourevo is a tool, not an adviser
Sourevo does not provide legal, customs or technical advice and does not certify that any product is deforestation-free or legally produced. Validations, warnings and the trust indicator are aids for your work; they do not replace your risk assessment or your judgement.
The EUDR obligations are yours, according to your role (operator, downstream operator or trader), or those of the company you represent: collecting information, assessing and mitigating risk, submitting the DDS where it is your duty, and keeping the records and statements for at least five years (articles 4, 5, 9 and 12 of Regulation (EU) 2023/1115). Using Sourevo does not transfer those obligations or your responsibility before the authorities.
4. Submissions to TRACES NT
- Statements are sent to TRACES NT only when you expressly instruct it in the application (or through an integration you set up), with data you have reviewed and with the operator’s web-service credentials that you provide.
- Before the authorities, the declarant is the operator (or the authorised representative submitting on its behalf), not Sourevo. By making the DDS available to the authorities, the operator assumes responsibility for the product’s compliance (art. 4(3) EUDR). We only transmit your instruction as a technical tool.
- The web-service credentials identify the operator to TRACES NT: whatever is submitted with them is attributed to that operator. Only give us credentials you are entitled to use.
- If you act as an authorised representative (art. 6 EUDR), you warrant that you hold the operator’s mandate to submit on its behalf and can provide a copy to the authorities if they ask. The operator remains responsible for compliance.
- Reference and verification numbers are issued by TRACES NT. Sourevo shows you the system’s response, including errors, as received.
- TRACES NT is operated by the European Commission. We are not liable for its outages, changes, rejections or delays. We recommend not leaving submission to the last moment before customs clearance.
5. Simulated mode
Until the connection to the TRACES NT production environment is enabled (which requires passing the Commission’s conformance tests), the service may run in simulated mode, shown by a visible banner in the application. In that mode:
- Nothing is sent to TRACES NT or to the European Commission. No statement made in simulated mode counts as submitted.
- Reference numbers starting with «SIM», and the statuses and responses that come with them, are generated by Sourevo so you can test the flow. They are not issued by TRACES NT and do not prove that a DDS exists.
- Do not use those numbers before customs, your customers or any authority, and do not place on the market or export products relying on them. Any such use is at your sole risk.
- The same applies to anything submitted in the TRACES NT test (acceptance) environment, if we give you access: it has no validity.
- A simulated statement is not sent automatically once real submission is enabled. To submit it you will have to review it and give the instruction again.
We will let you know when real submission is available for your account. From then on the banner disappears and the references you see will be those issued by TRACES NT.
6. Your account
- Provide accurate registration details and keep them up to date.
- Keep your password secret. You are responsible for activity in your account and must tell us as soon as you suspect unauthorised access.
- An organisation’s owner or administrator decides who gets access and with which role, and must remove access for anyone who no longer needs it.
- TRACES NT credentials you store are kept encrypted and used only for the operations you instruct.
Supplier accounts are free of charge for the supplier.
7. Acceptable use
You must not:
- Enter data that is false or that you know to be inaccurate, or use the service to evade the EUDR or mislead an authority.
- Upload third parties’ personal data without a legal basis.
- Attempt to access other organisations’ data, test security without permission, introduce malicious code or overload the system.
- Extract data massively or automatically outside the intended integrations, reverse-engineer the software or resell the service without a written agreement.
If we detect such use we may suspend access, notifying you unless urgency or the law prevents it.
8. Accuracy of the data you enter
You are responsible for the data you enter or import (suppliers, plots and their geolocation, quantities, product codes, evidence, operator details) being accurate, complete, lawful and up to date, and for having the right to use it. Review each statement before submitting it. We are not liable for penalties, detained goods or losses arising from inaccurate data or from decisions you make with the tool.
Data a supplier declares in its portal is that supplier’s responsibility. As a customer, verifying it is part of your due diligence.
9. Prices, trial and payment
Prices shown on the website exclude VAT. Annual packs of 10, 25 or 50 statements for €390, €790 and €1,290 (one-off payment, valid 12 months, no automatic renewal, 500 monitored plots). Pro plan: €2,990 a year, €299 a month with a 12-month commitment or €349 a month without commitment, with 150 statements a year (on monthly plans they build up month by month, 12.5 a month) and €490 onboarding on monthly plans. Forwarder plan: €4,900 a year or €490 a month with a 12-month commitment, with 300 statements and 10 represented companies, and €990 onboarding. Enterprise plan: from €7,900 a year, as quoted, with a service level agreement (SLA) signed separately. What each plan includes (statements, operators, users and plots) is what the pricing page and Plan and billing show when you order, or what the quote you accept in writing says.
What counts as a statement: only the first submission that TRACES NT accepts in production and that returns a reference number. Amendments, withdrawals, retries after an error, rejected submissions and anything submitted in simulated mode do not count. You may group several shipments in one statement.
Extra statements: we never block a submission because the included statements are used up. We warn you at 80% and 100%, and extra ones are billed monthly in arrears at your plan’s price: on packs, the pack’s unit price (€39, €31.60 or €25.80); on Pro, €19; on Forwarder, €12, and €9 from statement 2,000 of the year; on Enterprise, as quoted. They are charged to the saved payment method; if there is none, we send you the invoice to pay by bank transfer.
Packs: statements you do not use carry over once to the next pack if you buy it before the current one ends; otherwise they expire. Pro, Enterprise and Forwarder do not carry over. Unused statements are not refunded.
Payment and invoice: you pay in advance by card or SEPA direct debit through Mollie B.V., a payment institution authorised in the Netherlands. By paying, you authorise that payment method to be used for renewals and extra statements too. We issue an invoice for every charge. Customers in Spain are charged Spanish VAT; businesses in another EU country with a VAT number valid in VIES are invoiced under the reverse charge; outside the EU the supply is not subject to Spanish VAT.
The trial lasts 14 days from sign-up, with every feature in simulated mode: no statement is submitted to TRACES NT during the trial. A trial does not turn into a paid plan unless you expressly order one, and nothing is charged unless you give your payment details.
If you subscribe, you keep what you set up during the trial: organisation, users, operators, suppliers, plots, evidence, products, batches and draft statements. Statements submitted in simulated mode and their SIM references are not kept as statements: they are deleted or turned back into drafts so you can submit them for real, and they are not part of the statement archive.
We may change prices with at least 30 days’ notice. If you disagree, you may cancel before they apply.
10. Availability and support
We use reasonable means to keep the service available and secure, but do not guarantee it will run without interruptions or errors. There may be downtime for maintenance (if planned, we try to do it outside business hours and give notice) or due to failures of third parties we depend on (TRACES NT, public tax registries, hosting or email providers).
Unless we sign a service level agreement (as on the Enterprise plan or in a custom agreement), there are no availability or response-time commitments. Support is provided by email at juan.canton@sourevo.com.
We are not liable for delays or failures caused by force majeure, that is, events beyond our control that we could not foresee or avoid.
11. Liability
- Our total liability to you for any cause related to the service is limited to the amount you paid us in the 12 months before the event giving rise to it. For trial accounts, which only work in simulated mode and submit nothing to TRACES NT, and for supplier accounts, which are free and do not submit statements, to €100.
- We are not liable for indirect damage, loss of profit, loss of business, loss of data you could have avoided with your own copies, or administrative penalties imposed for breaching obligations that are yours.
- These limitations do not apply in case of wilful misconduct or gross negligence, or to anything the law does not allow to be limited.
12. Intellectual property
The Sourevo software, brand and content are ours or used under licence. We grant you a non-exclusive, non-transferable right to use them while your account lasts, for your internal purposes only.
Your data is yours. You give us only the permission needed to host and process it to provide the service, and we use it for nothing else.
If you send us suggestions, we may freely include them in the product with no obligation to compensate you.
13. Personal data
We process your account data under the privacy policy. Personal data your organisation uploads or uses in the tool (suppliers, plots, evidence, operator details and the content of statements) is processed by us as a processor on your organisation’s behalf, under the data processing agreement, which forms part of these terms and is accepted with them.
14. Term, cancellation and suspension
- These terms apply for as long as you have an account. Pro and Forwarder plans, yearly or monthly, renew automatically for equal periods until you cancel the renewal, which you can do at any time from Plan and billing or by writing to us. On plans with a 12-month commitment, the months left until the end of the commitment are paid even if you cancel earlier. Packs do not renew automatically.
- You can cancel at any time by writing to us or from the application, where available. Cancellation takes effect at the end of the period already paid and does not entitle you to pro-rata refunds, unless the reason is a breach on our side.
- If we cannot collect a renewal, the plan keeps working for 7 days so you can sort it out; then it ends. Your data is kept.
- We may suspend or close an account if you seriously breach these terms, fail to pay, or the law requires it. Otherwise, we may stop providing the service with at least 60 days’ notice.
- If you want to move your data to another provider or to your own systems, you can ask us with up to two months’ notice, also during an annual period. We help you switch at no cost and the service keeps running during the transition, which lasts no more than 30 days.
15. Export and deletion of your data
While you have an account, and for at least 30 days after cancellation or the end of the transition, you can ask us for a free export of your data in a structured, commonly used, machine-readable format. It includes organisations and users, suppliers, plots (GeoJSON), evidence (the original files), products, batches and statements with their reference numbers and history (CSV or JSON). It does not include internal security data such as password hashes or encryption keys. If you ask for it, we deliver it within 30 days at most.
After that period we fully delete your organisation’s data, except what we must keep by law and the archive of statements, which is kept blocked as explained in the data processing agreement unless you ask us to delete it earlier. Bear in mind that the obligation to keep the records for five years is yours: keep your own copy.
16. Communications
We will write to your account email about anything affecting the service. You can write to us at juan.canton@sourevo.com.
17. How the contract is concluded
- The contract is concluded electronically: when you create the account you tick the box accepting these terms, which links to their full text. Before submitting the form you can review and correct the details you entered.
- We record the date of your acceptance and the version of the terms you accepted. You can save or print this page at any time and, if you ask, we will send you the version you accepted.
- The contract is concluded in Spanish or English, depending on the language you sign up in. In case of discrepancy, the Spanish version prevails. This English version is a translation provided for convenience; the Spanish text is the binding one.
- Paid plans are ordered in the application (Plan and billing), where you see the total including taxes before paying, or with the quote or order you accept in writing.
18. Changes to these terms
We may update these terms to reflect changes in the law, the EUDR or the product. If the change is material, we will give you at least 30 days’ notice by email or in the application. If you disagree, you may cancel before it takes effect; if you keep using the service afterwards, you are deemed to accept it.
19. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute, both parties expressly submit to the courts of the city of Barcelona (Spain), waiving any other jurisdiction.
If any clause is held void, the rest remains in force. These terms, together with the quote you accept and the data processing agreement, are the entire agreement between the parties about the service; in case of conflict, any specifically signed document prevails.
